State law (labor code 6404.5) prohibits smoking in all enclosed workplaces with the exception of tobacco only retailers, owner-operated bars and businesses with five or fewer employees not open to the public and with the agreement of all employees. State law also prohibits the selling of tobacco products to persons under age 18 or purchasing products for persons under age 18 (Penal Code 308).
